1. Acceptance of Terms

By accessing or using ExemptPay ("the Service"), available at exemptpay.com, you agree to be bound by these Terms of Use. If you do not agree, do not use the Service.

2. What ExemptPay Does

ExemptPay provides nonprofit compensation benchmarking tools. We aggregate publicly available data from IRS Form 990 filings and the Bureau of Labor Statistics to help nonprofit organizations compare executive and staff compensation. Our service generates reports, search results, and data visualizations based on this public data.

3. This Is Not Professional Advice

ExemptPay is not a law firm, accounting firm, or compensation consulting firm. Nothing on this site constitutes legal, tax, accounting, or professional compensation advice.

Our reports are informational tools designed to support your board governance process. They are not a substitute for independent professional judgment. You should consult qualified legal, tax, and compensation professionals before making compensation decisions for your organization.

We do not guarantee that using our reports will satisfy IRS requirements for the rebuttable presumption of reasonableness or any other regulatory standard. Compliance with IRS rules, including the intermediate sanctions provisions of Section 4958 of the Internal Revenue Code, is your organization's responsibility.

4. Data Accuracy and Limitations

The compensation data in ExemptPay comes primarily from IRS Form 990 filings, which are self-reported by nonprofit organizations. We also use data from the Bureau of Labor Statistics.

  • We do not independently verify the accuracy of data reported to the IRS or BLS.
  • Source data may contain errors, omissions, or outdated information.
  • There is typically a 1–2 year lag between when compensation is paid and when the corresponding Form 990 data becomes publicly available.
  • Our title normalization and clustering processes use automated methods (including AI) that may occasionally misclassify job titles.
  • Statistical benchmarks are based on available data and may not reflect your specific labor market, region, or organization type.

We make reasonable efforts to process and present data accurately, but we do not warrant that any data, report, or analysis is complete, current, or error-free.

5. Your Account

When you create an account, you agree to provide accurate information and keep your login credentials secure. You are responsible for all activity under your account. Notify us at support@exemptpay.com if you suspect unauthorized access.

6. Acceptable Use

You agree not to:

  • Scrape, crawl, or use automated tools to extract data from the Service beyond normal use of the provided interface and APIs.
  • Resell, redistribute, or commercially exploit data or reports obtained from the Service without our written permission.
  • Present ExemptPay reports as independent professional compensation studies or opinions authored by a qualified compensation consultant.
  • Use the Service for any unlawful purpose or in violation of any applicable regulations.
  • Attempt to interfere with or compromise the integrity or security of the Service.

7. Intellectual Property

The ExemptPay name, logo, website design, report templates, software, and compiled data presentations are our property or licensed to us. You may not copy, modify, or distribute them without permission.

The underlying IRS Form 990 and BLS data is in the public domain. Our intellectual property rights apply to how we organize, present, analyze, and deliver that data — not to the raw public records themselves.

8. Paid Subscriptions

Some features require a paid subscription. Payments are processed by Stripe. By subscribing, you authorize recurring charges at your selected plan's rate.

  • You may cancel your subscription at any time through your account settings or by contacting us.
  • Cancellation takes effect at the end of your current billing period. You retain access until then.
  • We do not provide refunds for partial billing periods.
  • We may change pricing with 30 days' notice. Continued use after a price change constitutes acceptance.

9. Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by law, ExemptPay shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, arising from:

  • Your use of, or inability to use, the Service.
  • Any compensation decisions made by you or your organization based on data or reports from the Service.
  • Errors, inaccuracies, or omissions in the data we present.
  • Any unauthorized access to or alteration of your data.

Our total liability for any claim arising from or related to these Terms or the Service is limited to the amount you paid us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless ExemptPay and its operators from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

11. Termination

You may delete your account at any time through your account settings. We may suspend or terminate your access if you violate these Terms, with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive (including limitation of liability, indemnification, and intellectual property) will remain in effect.

12. Changes to These Terms

We may update these Terms from time to time. We will post the revised version on this page with an updated effective date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Texas.
